Athletes USA LTD (“Athletes USA”) has created this privacy statement in order to demonstrate our commitment to privacy. Due to the sensitive nature of the information we collect from our users, and Clients, including address and phone numbers, we believe it is important to satisfy strict privacy requirements. The following discloses our information gathering and dissemination practices for this Web site:

Collected Information

The following section describes the information we collect from you and indicates the primary purposes why we collect each type of information from you. If we use your information or disclose or distribute your information to third parties for a purpose that is not related to the following purposes, we will notify you by email of your right to opt-out of that use, disclosure or distribution beforehand. Your right to opt-out shall be governed by the Choice/Opt-Out Section below.

As described below in more detail, we use your IP address to help diagnose problems with our server, and to administer our Web site. Our site uses cookies to keep track of your session ID

We may use cookies to deliver content specific to your interests. Our site’s registration and order form requires users to give us contact information (such as name and email address), unique identifiers (such as social security number), financial information (such as account or credit card numbers), and demographic information (such as age or income level). The user’s contact information is used to contact the user when necessary. Users may opt-out of receiving future mailings as set forth in the Choice/Opt-Out section below. Financial information that is collected is used to check the users’ qualifications for registration and to bill the user for products and services. We use this data to tailor the user’s experience at our Web site, showing them content that we think they might be interested in, and displaying the content according to their preferences.

This Web site has security measures in place to protect the loss, misuse and alteration of the information under our control. All user data is stored on our servers.

Data Access & Accuracy

Athletes USA is not responsible for inaccuracies in data provided by third parties, such as credit reporting bureaus. You may review your data by calling Athletes USA at the telephone number provided below. Any inaccuracies in your data may be corrected through a telephone call to us, at the telephone number below.

Data Protection for Athletes USA Clients

All personal data held by the Athletes USA relating to the Client shall (save with the prior consent of the Client) be used for the purposes and in accordance with the terms set out in Client’s Amateur Athlete Marketing Agreement only, and the Client hereby consents to such use. Athletes USA confirms that it shall process the Client’s personal data in accordance with the terms of the Data Protection laws in the United States. The Client acknowledges that in order for Athletes USA to provide the Services and conduct its business it will be necessary for the Athletes USA (i) to provide all or part of the Client’s personal data to those Colleges and Coaches that have been contacted by the Athletes USA or have contacted the Athletes USA seeking further information in respect of sportspersons dealt with by the Athletes USA and (ii) to provide all or part of the Client’s personal data to its insurers, and that such officials and Coaches are ordinarily located, and such insurers or their data storage facilities may be located, and that these persons may not have entered into a written agreement with the Athletes USA concerning their use of that personal data.


Our Web site provides users the opportunity to opt-out of receiving communications from Athletes USA at the point where we request information about the user. This Web site gives users the following options for removing their information from our database to not receive future communications or to no longer receive our service.

Change in Control

If we experience a “change in control” (defined below), we may amend our information practices as described in this privacy statement. Athletes USA is an international athletic consultancy company, providing services to both international student athletes and member institutions. The services that Athletes USA provides are consistent with the following NCAA definition (April 1, 2011):

“The academic and membership affairs staff confirmed that a recruiting or scouting service includes any individual, organization, entity or segment of an entity that is primarily involved in providing information about prospective student-athletes. This definition includes, but is not limited to any service that provides information only to paid subscribers, any service that is only available to a select group of individuals (e.g., coaches), regardless of whether there is a charge associated with the service, and any service that provides information to the public free of charge; however, this definition does not include any individual, organization or entity or segment of an entity that provides information about prospective student-athletes incidental to its primary purpose and is generally available to the public (e.g. news media).”

Athletes USA’s service is fully compliant with NCAA rule 13.14.3 “Recruiting or Scouting Services”, and Athletes USA will ensures that its service:

(a) Is made available to all institutions desiring to subscribe and at the same fee rate for all subscribers;

(b) Publicly identifies all applicable rates;

(c) Disseminates information (e.g., reports, profiles) about prospective student-athletes at least four times per calendar year;

(d) Publicly identifies the geographical scope of the service (e.g., local, regional, national) and reflects broad-based coverage of the geographical area in the information it disseminates;

(e) Provides individual analysis beyond demographic information or rankings for each prospective student-athlete in the information it disseminates;

(f) Provides access to samples or previews of the information it disseminates before purchase of a subscription; and

(g) Provides video that is restricted to regularly scheduled (regular-season) high school, preparatory school or two-year college contests and for which the institution made no prior arrangements for recording.
